These terms govern every purchase made through secret-samples.com. Your contract is with JRM-Studios; Secret Samples is the brand it trades under. Please read section 5 before you buy – once you start the download, your right of withdrawal ends.
The seller in every transaction is JRM-Studios, owner Johannes Riedl, Oberer Steinweg 9, 75438 Knittlingen, Germany (“we”, “us”). Secret Samples is an unregistered brand of JRM-Studios and not a legal entity of its own. Our full details are in the legal notice.
These terms apply to all contracts concluded through this website. Any terms of your own that conflict with these apply only if we have agreed to them in writing.
The presentation of instruments on this website is not a binding offer. By completing the checkout you make a binding offer to buy the instrument shown.
Checkout is operated by Stripe Payments Europe, Ltd. on our behalf. The contract comes into effect when we confirm your order by email – in practice, the message carrying your download link. We store the text of the contract and will send you a copy of your invoice again on request.
If you are under 18, you may only buy with the consent of a parent or guardian, and with their authorisation for the payment method used.
The prices shown on this website apply, plus the rate of VAT in force at the time of your order. Payment is handled by Stripe; we have no influence on how Stripe processes payments, and Stripe may collect further personal data under its own privacy terms. Which payment methods are available is shown at checkout.
If someone else uses your payment method or account without authorisation, tell us as soon as you notice. You are not liable for fraudulent use that you did not cause.
Our instruments are digital goods, delivered as a download. After your payment is confirmed, you receive an email with a download link. The instruments are supplied in Kontakt format and require the full version of Kontakt 6.7.0 or later; the free Kontakt Player is not sufficient. The system requirements on each product page form part of the agreed condition of the goods.
The download link is valid for three days and may be used three times. That is deliberately generous enough for a failed transfer or a second machine, and short enough that a link passed on to someone else is worth nothing. Please download your instrument and keep your own backup of the files.
Need it again later – a new computer, a lost drive, a fresh system? Write to john@secret-samples.com from the email address you bought with, or quote your order number, and we will issue a new link. We do this for as long as the instrument is in our catalogue, and we do not charge for it. If a download fails for technical reasons, the same address gets you help.
If you are a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The period begins on the day the contract is concluded.
To withdraw, send us a clear statement of that decision – an email to john@secret-samples.com is enough. Sending it before the period expires is sufficient to meet the deadline. If you withdraw, we refund all payments received from you without undue delay and no later than fourteen days after we are informed, using the same means of payment you used, at no charge to you.
When the right ends. Because these are digital goods supplied without a physical medium, your right of withdrawal expires once we have begun performance – that is, once the download is made available to you – provided that you have expressly consented to us beginning before the withdrawal period ends, and have confirmed that you understand this ends your right of withdrawal. You give both confirmations at checkout. Until you do, delivery does not start.
This section replaces the earlier blanket statement that payments were non-refundable. Your statutory rights as a consumer are not restricted by these terms.
All instruments sold here are protected by German copyright law, and we hold the rights to license them. On full payment you receive a simple, non-exclusive, perpetual right to use the instrument you bought.
What that licence allows and what it does not – installation across your own machines, commercial use of whatever you produce, solo use, and the limits on passing the samples on – is set out in our licence agreement. It forms part of this contract and you can read it in full before you buy. The same text travels inside every download, so you always have it to hand.
We keep the licence in one document rather than restating it here, so that there can never be two versions of it saying different things. Where this contract and the licence agreement differ, this contract applies.
Statutory rights in respect of defects apply. If an instrument does not have the agreed condition – it does not load in a supported version of Kontakt, files are missing, samples are corrupted – tell us and we will put it right.
Sonic characteristics that are part of the recordings are not defects. Our instruments are recorded as dry as possible and deliberately keep the roughness of the source: uneven tuning, noise, irregularities in the material. That is the product, and the demos on each product page show you what it sounds like before you buy.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.
For slight negligence we are liable only where we breach an obligation that is essential to the proper performance of this contract and on whose fulfilment you may regularly rely. In that case our liability is limited to the damage that was foreseeable and typical for this kind of contract.
Any further liability is excluded. This does not alter the burden of proof to your disadvantage.
We answer support requests sent to john@secret-samples.com, usually within two working days. See the support page for what helps us answer in one reply.
We cannot guarantee that this website is reachable at all times. Maintenance, faults at our hosting provider, failures of networks we do not operate, and events outside our control may interrupt it. Interruptions of this kind do not affect instruments you have already bought.
If you use an instrument in breach of these terms and that causes a third party to bring a claim against us, you are responsible for it and will indemnify us against such claims. This does not apply where you are not at fault.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only in so far as it does not deprive you of the protection of mandatory provisions in the country where you are habitually resident.
If you are a merchant, a legal person under public law or a special fund under public law, or if you have no general place of jurisdiction in Germany, the place of jurisdiction for all disputes arising from this contract is the seller’s registered office. As a consumer, you are not affected by this: you may always bring proceedings, and will always be sued, at the court for the place where you live.
Should any provision of these terms be or become invalid, the remainder stays in force. The statutory provisions then apply in place of the invalid provision.
